— Ethan BarnardWhat Henderson Municipal Court handles
Henderson is a separate city with a separate court system.
Henderson is the second-largest city in Nevada and it operates its own municipal court. If you were arrested by Henderson Police Department within Henderson city limits, your misdemeanor or gross misdemeanor case will be filed here — not at Las Vegas Justice Court. The Henderson City Attorney prosecutes these cases, not the Clark County District Attorney.
The court handles misdemeanors including DUI, domestic battery, petit larceny, trespassing, simple assault, and disorderly conduct. It also handles Henderson city code violations and traffic offenses issued by Henderson PD.
For felony arrests made by Henderson PD, the court handles the initial appearance and can conduct preliminary hearings. If probable cause is found, the felony case transfers to the Eighth Judicial District Court in Las Vegas. The felony trial, sentencing, and all subsequent proceedings happen in district court.
The misdemeanor process at Henderson Municipal Court
From your first appearance to case resolution.
Arraignment
Your first court appearance. The judge reads the charges, advises you of your rights, and takes your plea — not guilty in almost all cases at this stage. The judge sets bail conditions or releases you on your own recognizance. If you have an attorney, your attorney handles the talking and can argue for favorable release conditions.
Pretrial conferences
Your attorney and the Henderson City Attorney prosecutor exchange discovery — police reports, body camera footage, witness statements, lab results. Plea negotiations happen here. The prosecutor may offer a plea deal. Your attorney evaluates the evidence and advises you on the best course of action. Multiple pretrial dates are normal.
Motions and hearings
If there are legal issues with the arrest, the search, the evidence collection, or Miranda warnings, your attorney files motions. A motion to suppress evidence can remove key evidence from the case. A motion to dismiss can end the case entirely. The judge holds a hearing, hears arguments, and rules.
Resolution or trial
Most cases resolve through plea negotiation — reduced charges, dismissed charges, or diversion programs. If no agreement is reached, the case goes to trial. You have the right to a jury trial on any criminal charge. Henderson Municipal Court jury trials use a six-person jury. You can also choose a bench trial decided by the judge.
Sentencing
If convicted by plea or at trial, the judge imposes a sentence. Possible sentences include jail time (up to 6 months for misdemeanors, up to 364 days for gross misdemeanors), fines, community service, counseling classes, probation, and restitution. First offenses often result in probation, but charges like DUI and domestic battery carry mandatory minimums.
Henderson-specific procedures
Things that work differently here than in Las Vegas Justice Court.
Henderson Municipal Court is smaller than Las Vegas Justice Court, and that affects how cases move. The docket is lighter, which can mean faster court dates and more individual attention from the judge. It can also mean less flexibility on scheduling because there are fewer available dates.
The Henderson City Attorney's office prosecutes misdemeanor cases, not the Clark County District Attorney. This matters because plea policies, diversion program eligibility, and negotiation tendencies differ between the two offices. A defense attorney who regularly practices in Henderson understands these differences and can use them to your advantage.
Henderson also participates in specialty court programs. If you qualify, these programs can offer an alternative to traditional prosecution — treatment-focused approaches for DUI offenses, mental health issues, or substance abuse. Your attorney can assess whether you are eligible and whether a specialty court track would lead to a better outcome than the standard process.
Appeals from Henderson Municipal Court go to the Eighth Judicial District Court for a trial de novo — meaning a completely new trial in front of a district court judge. This is a powerful right. If you are convicted in Henderson Municipal Court and believe the outcome was unfair, a de novo appeal gives you a second chance with a fresh judge who hears the case from scratch.
